GENERAL CONDITIONS OF SALE

Article 1 – Scope

1.1 The company OLiMPE (simplified joint stock company with capital of 10,000 euros, located at 88 Rue du Dôme – 92100 BOULOGNE BILLANCOURT, registered with the RCS of NANTERRE under the number 829 602 465) (hereinafter “OLiMPE”) has published the website www.cti360congress.com (hereinafter the “Site”) to enable registration to the “Cell Therapy Innovation 360 °” congress to give access to several scientific sessions organized on January 25 & 26, 2023, in the premises of the National Superior School (ENS) of Lyon located at 46 Allée d’Italie in LYON (69000) – France (hereinafter the “Event”).

1.2 These general conditions of use of the site and of sale (the “General Conditions”) apply, to the exclusion of any other stipulation, to any individual registration of a participant (hereinafter the “Participant”) to the Event, either online or by email / by post by sending the duly completed and signed registration form. It is specified that, besides their registration to the Event, pharmaceutical industries may enter, within the Event, a partnership with OLiMPE which shall not fall within the scope of the General Conditions.

1.3 These General Conditions can be viewed on the Site.

1.4 The fact of registering for the Event either online or by email or post by sending the duly completed and signed registration form, constitutes outright and full acceptance by the Participant of these General Conditions.

1.5 OLiMPE reserves the right to modify these General Conditions at any time. Only the General Conditions in force on the day of registration will apply to the registration concerned.

Article 2 – Registration for the Event

2.1 Registration can be done online by completing the registration form directly on the Site. To place an order, it will be up to the Participant to follow the following steps: – choose from the online registration forms the one corresponding to his professional status; – complete, online, the registration form and attach, for Participants other than Doctorsand Pharmaceutical representatives outside the package, the documents proving their professional status; – accept the General Conditions; – validate the summary of the order using the “Confirmation of the order” section; – make online payment in accordance with Article 3 hereof and confirm the method of payment via the “Payment” section.

The data recorded by OLiMPE when confirming the order constitutes proof of transactions between OLiMPE and the Participant. This order confirmation is communicated to the Participant by e-mail summarizing the contractual information relating to the order. A digital invoice is sent by email.

Any order associated with payment by credit card is not considered effective until the online payment organization has given its consent. In case of refusal of the said organization, the order will be automatically canceled.

Once OLiMPE has received the duly completed and signed inscription form as well as the actual payment, it will send the Participant an order confirmation summarizing the contractual information relating to the order. A digital invoice will also be emailed.

2.2 OLiMPE recommends that the Participant print and / or archive, on a reliable and durable medium as proof, the order confirmation as well as the electronic invoice.

2.3 OLiMPE reserves the right to refuse any order from a Participant with whom there is or has been a dispute, in particular with regard to payment for a previous order. Any incomplete or incorrect order will not be taken into account.

2.4 In any event, regardless of the method of payment, orders will not be validated and therefore effective until the effective receipt of the price for the entire order. Any order older than one month and for which no valid payment has been received will be automatically canceled. Any canceled order will result in a cancellation notice (either directly on the Site when processing the order online, or subsequently by email).

2.5 When validating the registration, OLiMPE reserves the right to add the participant to the newsletter of future events.

Article 3 – Prices – Registration regulations

3.1 The prices specified on the Site are given in euros and presented before taxes and all taxes included. The applicable prices are those indicated on the Site on the date of the order confirmation. Prices are subject to change at any time, in particular due to an introductory offer and promotional campaigns. No price changes will apply to orders in process.

Prices include: the name badge for access to all scientific sessions over the two (2) days, the congress package including the Event program, the certificate of attendance, lunches and coffee breaks on January 25 & 26, 2023.

Unless expressly authorized by OLiMPE, no discount or installment payment is granted.

3.2 Rates can be paid as follows:

– online directly on the Site, using a secure payment system. The OLiMPE payment system has been entrusted to a service provider specializing in secure payments

online compliant with the Payment Card Industry Data Security Standard (PCI DSS) °;

– by check payable to OLiMPE or by bank transfer should the Participant register by email or post.

Only one payment method is authorized per registration.

Article 4 – Right of withdrawal

Pursuant to article L.121-20-12 of the French Consumer Code, the Participant (if he acts as consumer) has a period of fourteen (14) calendar days from the confirmation of the order to exercise his right of withdrawal, without having to give a reason, nor bear penalties. As an exception, the exercise of this right of withdrawal cannot be exercised fourteen (14) calendar days before the start of the Event.

If the Participant wishes to exercise his right of withdrawal, he must send notification, within the aforementioned legal period, by returning the standard form attached at the end of these terms to the following address: OLiMPE – Madame Mathilde LEGOFF – 88 Rue du Dôme – 92100 BOULOGNE BILLANCOURT.

If it had been cashed, the registration price will be fully refunded within a maximum period of fourteen (14) days.

Article 5 – Modification – cancellation

5.1 Modification

OLiMPE reserves the right to modify the Event program, particularly in the absence of a speaker.

Any modification affecting the Event will not give rise to any right to a refund or to compensation of any kind.

5.2 Cancellation at the initiative of the Participant

In the event that, the withdrawal period having expired, the Participant wishes to cancel his participation in the Event, the cancellation must be notified, in writing, as follows: – by post to the following address: OLiMPE – 88 Rue du Dôme – 92100 BOULOGNE BILLANCOURT, France; ; – by email:b.agius@pegase-healthcare.com. For any cancellation received by OLiMPE up to December 22, 2022, inclusive, all amounts paid will be refunded less administrative fees of €30 including tax. Reimbursement will be made after the date of the Event and using the same payment method as that used by the Participant to pay for their participation in the said Event.

For any cancellation received by OLiMPE from December 23, 2022, for any reason whatsoever, no refund will be made.

5.3 Cancellation at the initiative of OLiMPE

In the event that OLiMPE is forced to cancel the Event, Participants will be informed as soon as possible. Participants will then be reimbursed for their registration fees.

As an exception, OLiMPE cannot be held liable and no refund will be made if the Event is delayed or canceled due to a case of force majeure. 

Article 6 – Intellectual property rights – Trademarks

6.1 All the content put online on the Site by OLiMPE, all the content broadcast and / or delivered during the Event, as well as the presentations by speakers are protected by copyright as outlined in articles L.111-1 and following of the French Intellectual Property Code. Consequently, except for specific permission each Participant is expressly informed that the aforementioned contents and presentations cannot be copied, reproduced, represented, transmitted, passed on or made available, exploited in any way whatsoever and on any medium whatsoever, under penalty of constituting an act of copyright infringement punishable by articles L.335-2 and L.335-3 of the French Code of Intellectual Property.

6.2 The Participant is informed that during the Event, OLiMPE may take pictures and / or video recordings. Unless expressly stated to the contrary, the Participant authorizes OLiMPE to photograph and film him/her as part of the Event and to distribute and reproduce these images via any media as part of communication on the Event.

OLiMPE is not responsible for the content of the presentations streamed nor for any comments made during the Event. It will be up to each of the Participants to verify the relevance of the opinions and recommendations that will be formulated by the speakers.

6.3 The semi-figurative French trademark “Cell Therapy Innovation 360°” has been filed and registered by the company OLiMPE with the French National Institute of Industrial Property on April 20, 2018, under the number 4447773. Consequently, any Participant engaging in its representation, reproduction, embedding or distribution incurs the penalties outlined in Articles L.713-2 et seq. of the French Intellectual Property Code. 

Article 7 – Accessibility of the Site

The Site is normally accessible 24/7 for all Participants. OLiMPE cannot, however, be held responsible for interruptions in the Site and its services, whether voluntary or not.

Accordingly, OLiMPE cannot be held responsible for any slowng down or difficulties in accessing the Site and reserves the right to temporarily interrupt access

to its services for the purpose of maintenance and / or improvement while committing to do everything possible to minimize this type of intervention.

OLiMPE reserves the right to make any modifications and improvements to the Site and to the services it houses it deems necessary or useful for the proper functioning of its Site and the services associated with it.

Use of the Site is at the Participant’s own risk. The Participant acknowledges this and undertakes to take all necessary precautions.

Consequently, OLiMPE cannot be held liable for any damage, in particular in the event of loss of data, or damage to the Participant’s equipment, which might occur due to the use of the Site. 

Article 8 – Confidentiality – Protection of Personal Data

Pursuant to the European General Data Protection Regulation No. 2016/679 (RGPD) dated April 27, 2016, that entered into force on May 25, 2018, the personal data requested from each Participant to process their registration and provide them with the best possible service are adequate, relevant, kept up to date, accurate and strictly necessary for the processing, management and monitoring of registrations, the establishment of invoices, attendance certificates and customer relationship follow up.

OLiMPE ensures the security of personal data, by implementing reinforced technical, legal and organizational measures. In order to ensure the efficient processing and security of personal data, it will communicate them to its IT, hosting and website management suppliers, from whom it requires sufficient guarantees regarding the protection of personal data that they process on its behalf.

OLiMPE ensures that its processing of Participants’ personal data is lawful. To this end, it ensures that each processing operation is justified by a valid legal basis, such as the individual’s consent, the need for the performance of a contract to which the data subject is a party, or the legitimate interests of OLiMPE.

OLiMPE keeps the personal data of each of the Participants only for the time necessary for the operations for which they were collected, in compliance with the legislation in force and taking into account the limitation periods.

Finally, each Participant has, in accordance with national and European regulations in force and within the limits of what is permitted by the said regulations, a right to permanent access, rectification, erasure, portability, limitation and opposition regarding information concerning them. Each Participant also has the right to define guidelines on the retention, erasure or communication of their personal data after their death, as well as the right to withdraw their consent to data processing at any time.

Article 9 – Miscellaneous

9.1 These General Conditions are governed by French law.

9.2 In the event that one of the stipulations of these General Conditions would be considered null by virtue of a legal or regulatory provision, present or future, or of a court decision with the authority of res judicata and emanating from a court or a competent body, this stipulation would be considered null, void or unwritten, all the other stipulations hereof will remain in force.
